These Terms and Conditions govern your use of and SMS service supplied by Stagetime Limited, and your relationship with the supplier of the Service, Stagetimes Limted, Glencoe Bush, Dungannon, Co.Tyrone, Northern Ireland. BT71 6QU (referred to below as "we", "our" and "us"). Please read them carefully as they affect your rights and liabilities under the law. If you do not agree to these Terms and Conditions, please do not register for or use the Service.

1. Use of the Service

The charges for your use of the Service are set are viewable at www.stagetimes.com, and is provided subject to these Terms and Conditions. By using the Service you agree to be bound by these Terms and Conditions. We may vary the charges for the Service from time to time by giving you not less than 30 days notice (giving you the opportunity to cancel before the variation takes effect).

2. Registration

You must ensure that the details provided by you on registration or at any other time are correct and complete. Should you details change, you must update your details immediataly the details via our admin section, at www.stagetimes.com/logon.asp

3. Excluded Services

The Service we provide does not include the provision of a mobile telephone or other suitable telephony equipment to access the Service. We shall not be liable for any telephone or other costs that you may incur.

4. Availability of the Service

Although we aim to offer you the best service possible, we make no promise that the Service will meet your requirements. We cannot guarantee that the Service will be fault free.

5. Our right to suspend or cancel the service

We may suspend or cancel your registration immediately at our reasonable discretion or if you breach any of your obligations under these Terms and Conditions. You can cancel this agreement at any time by informing us in writing or by using the shortcode given above. The suspension or cancellation of your right to use the Service shall not affect either party's rights or liabilities.

6. Intellectual property

The content of the Service is protected by copyright, trade marks, database and other intellectual property rights. We may send you content as part of the Service which you may display on your mobile telephone, store in electronic form on your mobile telephone and keep one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials provided by us as part of the Service without our written permission.

7. Our liability

The Service is provided by us without any warranties or guarantees. You must bear the risks associated with the use of the Service.

The Service includes material for your use and while we try to ensure that material included in the Service is correct, reputable and of high quality, we cannot accept responsibility if this is not the case. We will not be responsible for the results obtained from the use of such information or for any technical problems you may experience with the Service. If we are informed of any inaccuracies in the material included in the service we will attempt to correct the inaccuracies as soon as we reasonably can.

We will not be liable to you for any damages in excess of the amount of any fees that you have paid to us for the use of the Service. We will not be liable for any loss or damage caused by us or our employees or agents in circumstances where:
(i) we are not at fault for the errors or inaccuracies, or
(ii) the loss or damage is not foreseeable to both of us at the time of this agreement, or
(iii) the loss or damage is a business loss or the losses were caused in the course of business, including losses relating to lost data, lost profits or business interruption.

In particular, we disclaim all liabilities in connection with the following:

incompatibility of the Service with any of your equipment or telecommunications links;
technical problems including errors or interruptions of the Service;
failure of the Service to meet your requirements.

To the full extent allowed by applicable laws, you agree that we will not be liable to you or any third party for any consequential or incidental damages (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to the Service.

Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury caused by our own negligence.

8. Limitations

You may not use the Service for any of the following purposes:

damaging, interfering with or disrupting access to the Service or any other persons enjoyment of the service;
doing anything which may interrupt or impair the Service's functionality;
breaching any laws concerning the use of public telecommunications networks; and
making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner.

You will indemnify us against all losses, liabilities, costs and expenses reasonably suffered or incurred by us, all damages awarded against us under any judgment by a court of competent jurisdiction and all settlements, sums paid by us as a result of any settlement agreed by us arising out of or in connection with any claim by a third party that the use of the Service by you has resulted in loss and/or damage to be suffered by them.

9. International use

We make no promise that the Service is appropriate or available for use in locations outside the United Kingdom, and accessing the Service from territories where its contents are illegal or unlawful is prohibited. If you choose to access this Service from locations outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws.

10. Miscellaneous

You may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions.

If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.

If you breach these Terms and Conditions and we ignore this, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach the Terms and Conditions.

We shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond our control.

A person who is not a party to these Terms and Conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions but this shall not affect any right or remedy of a third party which exists or is available apart from the Act.

11. Amendments

We may update these Terms and Conditions form time to time. The changes will apply to your use of the Service after we used all reasonable attempts to issue you with the new Terms and Conditions. The lastest set of new and conditions are available at http://www.stagetimes.com/content/termsandconditions.asp. If you do not wish to accept the new Terms and Conditions you should not continue to use the Service. If you continue to use the Service after the date on which the change comes into effect, your use of the Service indicates your agreement to be bound by the new Terms and Conditions.

12. Applicable law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Northern Irealnd and only the Northern Ireland Courts will decide any disputes.
